BY SUBMITTING AN ENTRY FOR CONSIDERATION IN THIS CONTEST, ENTRANT HEREBY GRANTS SPONSOR RIGHTS TO USE THE ENTRANT’S NAME, LIKENESS, AND ENTRY MATERIALS, AMONG OTHER THINGS, NOW AND IN THE FUTURE. SEE RULE 11 FOR COMPLETE DETAILS.
1. OVERVIEW: The Margarita Madness contest (the “Contest”) is sponsored by Margaritaville Vacation Club, Inc., 501 W. Church St., Orlando, FL 32805 (“Sponsor”). The Contest takes place in two parts. An initial submission of a Recipe (as defined in Rule 4) (and optional Video, as defined in Rule 4) by Entrants to be judged by Sponsor representatives to identify four Finalists (as defined in Rule 6) who will receive a trip to Margaritaville Vacation Club Orlando where they will participate in Activities (defined in Rule 7), including making their Recipe, which Sponsor may Film (as defined in Rule 7) to share on Voting Sites (as defined in Rule 8) for public voting to determine the one (1) grand prize winner (“Winner”). In order to participate in the Contest and be considered for a prize, each Entrant agrees to comply with all requirements set forth in these Official Rules (“Rules”) and with Sponsor’s decisions and directions. In order to be verified as a Finalist or Winner, and to receive the prize associated with such designation, each potential finalist will be required to sign paperwork provided by Sponsor granting Sponsor the right to use their name, likeness, voice, image, biographical information, Recipe and any Finalist Footage (as defined in Rule 7) or Grand Prize Footage (as defined in Rule 9) Filmed by Sponsor (collectively “Footage”).
2. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States, District of Columbia and Puerto Rico, who are 21 years of age or older (each an “Entrant”). Employees of Margaritaville Vacation Club, Inc. and its affiliated companies, advertising/promotion agencies, and any other company or individual involved with the design, execution or administration of the Contest (collectively with Sponsor, the "Contest Entities") and any immediate family member (defined as a spouse, parent, or child; whether biological, adopted, step or in-law) or household member (whether related or not) of any such employee are not eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and to Sponsor's decisions, which are final and binding in all matters related to the Contest.
3. TIMING: The Contest begins at 12:00:01 a.m. Eastern Time (“ET”) on April 2, 2026 and ends when the Winner has been verified and completed their Grand Prize Trip (as defined in Rule 9), or when Sponsor announces the Contest has ended, whichever occurs first (“Contest Period”). Within the Contest Period, there is an Entry Period, Finalist Judging Period, Finalist Trip Period, and Public Voting Period, as defined below. The clock on Sponsor's server shall be the official timekeeping device for this Contest.
a. Entry Period. Entry into the Contest begins at 12:00:01 a.m. ET on April 2, 2026 and ends at 11:59:59 p.m. ET on April 24, 2026 (the "Entry Period").
b. Finalist Judging Period. Sponsor may start judging Entries (as defined in Rule 4) as they come in and will complete judging Entries and notify potential finalists by April 30, 2026 (the “Finalist Judging Period”).
c. Finalist Trip Period. The four Finalists will participate in a trip where they will be Filmed (as defined in Rule 7) creating their Recipe (as defined in Rule 4.b) and participating in other Activities (as defined in Rule 7) between May 16, 2026 to May 24, 2026 (the “Finalist Trip Period”).
d. Public Voting Period. Starting at 12:00 a.m. ET on Jun 1, 2026 and ending at 11:59:59 p.m. ET on June 4, 2026 Sponsor will post each Footage of each Finalist and their Recipe on the Voting Sites (as defined in Rule 8) (the “Public Voting Period”).
4. HOW TO ENTER: To enter the Contest, Entrants must visit https://mgvcgiveaways.com/marg-madness/rules (the “Contest Website”) and follow the on-screen directions to submit the following:
a. Official Entry Form. Entrants must complete the official online entry form found on the Contest Website with all required information including first and last name, home street address, date of birth, email address (which must remain the same throughout the Entire Contest Period as this will be the primary method of communication between Sponsor and Entrant), and Entrant’s confirmation that (s)he has read and agrees to the Rules (“Entry Form”).
b. Original Margarita Recipe. Entrants must upload an original margarita recipe (the “Recipe”) as specified on the Contest Website. The Recipe must meet the Additional Requirements detailed in Rules 5, below.
c. (Optional) Entrant Video. Entrants have the option of uploading a video of no more than two minutes in duration in which the Entrant appears and describes their margarita recipe (the “Video”). The Video is optional and will only be viewed by the judges in the event there is a tie in the scores to determine the top for Recipes submitted per the judging criteria set forth in Rule 6, below. If a Video is submitted, only one (1) person may appear in the Video, and that one person must be the Entrant identified on the Entry Form. The Video must meet the Additional Requirements detailed in Rules 5, below or it will not be considered as part of the Entry.
The Entry Form, Recipe and Video (if there is a Video) are together the Entrant’s “Entry.” Limit one (1) Entry per person and per email address. If more than one Entry is received from the same person or email address, all but the first Entry will be disqualified. Any Entries received that are not in conformance with these Rules will be disqualified. Entries become the property of Sponsor and may not be acknowledged and will not be returned.
5. ADDITIONAL REQUIREMENTS: Entries must meet the following additional requirements (“Additional Requirements”), all as determined by Sponsor in its sole and absolute discretion:
a. All written and spoken word in the Entry must be in English.
b. The entire Entry must be the original work of, and wholly created by, the Entrant.
c. Entrants must have all legal rights necessary to submit the Entry and to grant Sponsor the rights to use the Entry, in whole or in part, as authorized and contemplated in these Rules.
d. Entrants may not use artificial intelligence technology to create or submit an Entry.
e. The Entry cannot be derogatory of any ethnic, racial, gender, religious, professional, political or age group.
f. The Entry cannot be sexually explicit or suggestive, be unnecessarily violent, or contain profanity, nudity or pornographic material.
g. The Entry cannot depict or suggest any materially dangerous activity or any inappropriate content.
h. The Entry cannot depict, reference or promote illegal consumption of alcohol, excessive consumption of alcohol, illegal drug use or activity, tobacco use, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message.
i. The Entry cannot be obscene or offensive, defamatory, libelous, threatening, harassing, or endorse any form of hate or hate group.
j. The Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor, or other people, products, or companies.
k. The Entry cannot infringe on the rights of any third party (including, without limitation, any intellectual property rights, publicity rights or privacy rights; to this end, avoid using any brand names in your Recipe or showing any labels or copyrighted images in your Video).
l. The Entry cannot advertise or promote any brand or product of any kind other than the Sponsor’s, including, but not limited to, any of Sponsor’s competitors.
m. The Entry must not be, or contain anything that is, unlawful or in violation of or contrary to the laws or regulations of the United States or any state or jurisdiction therein.
In the event Sponsor determines that an Entry, or part of an Entry, violates any of these Additional Requirements, Sponsor reserves the right to void the entire Entry. Alternatively, in Sponsor’s sole and absolute discretion, Sponsor may modify the Entry (or portion thereof) to remove the portion that violates the Additional Requirements (e.g., remove a brand name and replace it with a generic name). Sponsor’s decision on how to treat an Entry that violates any Additional Requirements is not subject to objection or appeal.
6. FINALIST JUDGING: During the Finalist Judging Period, a panel of Sponsor’s representatives will judge all eligible Entries based on the following judging criteria with each criteria given equal weight:
a. Creativity of the Recipe;
b. Feasibility of the Recipe; and
c. Brand Fit of the Recipe.
The four Entrants with the overall highest scores on their Recipes after initial judging will be deemed the potential finalists, subject to verification. In the event of a tie for a potential finalist spot, the tie will be broken based on the Entrant who receives the highest score in the Brand Fit criteria. If a tied Entrant included a Video as part of their Entry, Sponsor will include that Entrant’s Video as part of the judging to break the tie (“First Tie Breaker”). If neither or none of the tied Entrants included a Video, or if a tie remains after the First Tie Breaker, Sponsor will select as the winner of the tie the tied Entrant who submitted their Entry first (“Second Tie Breaker”). The potential finalists will be notified by email at the email addresses each provided in their Entry Form (“Finalist Notification”). An Affidavit of Eligibility, Liability/Publicity Release (where legal), and Assignment of Rights in Entry and Footage (collectively “Finalist Documents”) will be attached to the Finalist Notification. Each potential finalist must complete, sign, have notarized where requested, and return the Finalist Documents in their entirety within five (5) days of the send date of the Finalist Notification. In the event a Finalist Notification is returned as undeliverable or if a potential finalist fails to return the completed Finalist Documents within the timeframe specified or if a potential finalist fails to comply with the Rules or is otherwise determined to be ineligible for any reason, that potential finalist will be disqualified and will forfeit any claim to the Finalist Trip or Grand Prize Trip. Once the Sponsor has received a potential finalist’s completed Finalist Documents and confirms that potential finalist is eligible and in compliance with all Rules and verification requirements, such potential finalist will be deemed a “Finalist.” In the event a potential finalist is disqualified, Sponsor, in its sole discretion, may notify the Entrant who had the next highest scoring Recipe (or Recipe/Video in the event of a First Tie Breaker) to be a potential finalist and complete the verification process detailed above, or Sponsor may choose to proceed with fewer Finalists. A maximum of four (4) Finalists will be verified to receive a Finalist Prize. If there are an insufficient number of qualified Entrants, Sponsor may reduce the number of Finalists.
7. FINALIST TRIP: The four (4) Finalists will each receive a 3 day/2 night trip for the Finalist and one guest to the Margaritaville Vacation Club Orlando in Orlando, Florida (the “Resort”) where they will participate in interviews and activities (collectively “Activities”) as determined and directed by Sponsor (the “Finalist Trip”). The Finalist Trip must be completed during the Finalist Trip Period. The Finalist Trip includes a $1000 flight credit for the Finalist to use to arrange travel to/from their home and Orlando, a balcony stateroom at the Resort during the Finalist Trip, and a $600 food credit to use at the Resort during the Finalist Trip. All other costs and expenses not expressly stated herein as being included in the Finalist Trip are the sole responsibility of the Finalist; this includes without limitation ground transportation, tips, damage fees, incidental fees, or food/beverage charges that are outside the scope or exceed the value of the food credit. Each Finalist will be required to provide a valid driver’s license or state identification card, and a valid credit card, prior to booking and check-in at the Resort. Finalists will be required to participate in all Activities requested by Sponsor between the hours of 8:00 a.m. ET and 8:00 p.m. ET on one day during the Finalist Trip (exact day and times to be determined by Sponsor) (the “Production Day”), not to exceed a combined total of eight (8) hours on the Production Day. One Activity that each Finalist should be prepared for on the Production Day is to make their Recipe while being filmed/recorded (the “Recipe Video”). Sponsor will provide the ingredients listed in the Recipe for the Recipe Video (exact brands of ingredients will be determined by Sponsor in its sole discretion). Sponsor may film, video or otherwise record (audio and/or visual) (collectively “Film”) all Activities on the Production Day, as well as any other activities that the Finalists participates in while in public areas of the Resort during the Finalist Trip (collectively “Finalist Footage”). The approximate retail value (“ARV”) of each Finalist Trip is $2400. Actual value may vary based on Finalist’s departure city and airfare rates at time of booking/travel. If actual value of trip is less than the ARV, the difference will not be awarded. Finalist Trip prizes are subject to additional details as noted in Rule 10.
8. PUBLIC VOTING: Sponsor will create a profile of each Finalist that includes all or part of the Recipe Video and other portions of the Finalist Footage (which may be edited by Sponsor in Sponsor’s sole discretion) collected during the Finalist Trip to create a “Finalist Profile.” Sponsor will share each Finalist Profile on Sponsor’s Instagram Stories [https://www.instagram.com/margaritavillevc/] and Facebook page [https://www.facebook.com/MargaritavilleVacationClub](together the “Voting Sites”) during the Public Voting Period, using each platform’s polling feature to collect votes for the Recipe you think is most creative and would most like to see on the menu (“Public Voting Criteria”). In order to vote, members of the public must have a valid account on the social media platform on which they seek to vote, but they do not have to be a follower of Sponsor’s page or account. Limit one vote per person/social media account per Voting Site. The Finalist that receives the most valid votes across both Voting Sites combined during the Public Voting Period will be deemed the Grand Prize Winner, subject to verification.
9. GRAND PRIZE TRIP: The one (1) Grand Prize Winner will receive a four (4) night cruise trip aboard the Margaritaville at Sea for winner and one guest (“Grand Prize” or “Cruise”). Trip includes a $1000 flight credit for the Finalist to use to arrange travel to/from their home and the airport nearest the embarkation and debarkation point for the Cruise. Cruise includes one (1) balcony stateroom for the Grand Prize Winner and one (1) guest, two (2) standard beverage packages that include alcoholic beverages, and standard onboard dining options included as part of the Cruise fare. The Grand Prize excludes any shore excursions, specialty dining venues or upgraded dining experiences that require an additional fee, spa services, premium activities, onboard purchases, and any other optional services or experiences not expressly included in the standard Cruise package.
10. . Sponsor may Film Grand Prize Winner and Guest while they are participating in any activities in public areas during the Cruise (“Grand Prize Footage”). All other costs and expenses not expressly stated herein as being included in the Grand Prize are the sole responsibility of the Grand Prize Winner; this includes without limitation travel expenses, food/beverage not included as part of the standard Cruise package, tips, damage fees, and incidental fees. ARV of Grand Prize: $2400 Travel dates are subject to availability and blackout dates may apply. Grand Prize must be completed by 6/1/2027 or it will be forfeited in its entirety and nothing awarded.
11. ADDITIONAL TRIP DETAILS AND PRIZE REQUIREMENTS: The Finalists and Winner (each a “Trip Winner”) must be able to travel on designated dates or by designated expiration date (as the case may be) or prize will be forfeited and an alternate Finalist or Winner may be selected, in Sponsor’s sole discretion. Trip Winner will be required to provide a valid credit card (to cover any expenses/fees incurred tat are not part of trip package), government issued identification, and any other required travel documentation (e.g., passport if necessary) prior to booking or upon check in (as directed by Sponsor). Finalists and Winner, and their Guests, are solely responsible for obtaining travel and medical insurance, and all other forms of insurance, that they deem necessary or advisable as Sponsor has not and will not obtain such insurance on their behalf. If a Trip Winner is allowed to bring a Guest, such Guest must be 21 years of age or older and Trip Winner must notify Sponsor in advance of booking of the name of such Guest. Guest must sign a Liability/Publicity Release and Assignment of Rights in Footage prior to booking and within time frame specified by Sponsor. Once made, all travel dates are final. If travel credits are provided, Trip Winner is responsible for booking travel within those amounts him/herself. Neither Sponsor nor any other of the Released Parties shall be responsible for any cancellations, delays, diversions or substitutions, or any acts or omissions whatsoever, by any carriers, hotel operators, venue operators, transportation companies or other persons in connection with the a trip. Without limiting the foregoing, neither Sponsor nor any other Released Parties will be in any way responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of a trip is delayed, postponed, re-scheduled or cancelled for any reason whatsoever (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate disease transmission, or due to any other cause of any kind or nature whatsoever). Travel is subject to the terms and conditions set forth in this Contest. Prizes will be awarded only if the potential winner fully complies with these Rules. Prizes are non-transferable and cannot be substituted or exchanged for cash, except by Sponsor in the event that an advertised prize becomes unavailable in which case Sponsor may award a prize of equal or greater value. The Trip Winner and Guest must travel together on the same itinerary. If Trip Winner does not take a Guest on a trip, no credit or refunds will be awarded.
Any tickets, vouchers, gift cards, gift certificates or like items (collectively “Vouchers”) issued in connection with this Contest are subject to the terms stated thereon or as set by the issuer. Sponsor will not replace any lost, mutilated, or stolen Vouchers. Prizes are not transferable and may not be redeemed for cash value. All federal, state and local taxes on prizes are the sole responsibility of the winner. No substitutions of prize, except Sponsor may substitute a prize, or portion thereof, for one of equal or greater value at Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion. Unclaimed prizes may not be awarded. The total ARV of all prizes for the Contest is $2400.
12. GRANT OF RIGHTS:
a. Participants Who Are Not Selected as Finalists.
i. Identity. By submitting an Entry or casting a vote, participants grant Sponsor, and anyone authorized by Sponsor (“Authorized Users”), the right to use their name, likeness, voice, statements, identity, and biographical information (“Identity”) for advertising and publicity purposes in any and all media now known or hereafter devised during the Contest Period and a reasonable run off period thereafter for purposes of promoting Sponsor and the Contest.
ii. Video. By submitting a Video, Entrants grant Sponsor and Authorized users the worldwide, royalty-free, non-exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Video, in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, during the Contest Period and a reasonable run off period thereafter for purposes of promoting Sponsor and the Contest.
iii. Recipe. By submitting a Recipe, Entrants grant Sponsor and Authorized Users a perpetual, worldwide, royalty-free, non-exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Recipe, in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
b. Finalists and Winner.
i. Identity. By submitting an Entry and accepting a trip, Finalists grant Sponsor and Authorized Users the right to use their name, likeness, voice, statements, identity, and biographical information (“Identity”) for advertising and publicity purposes in any and all media now known or hereafter devised for advertising, marketing and publicity purposes without territorial or time limitations.
ii. Recipes and Videos. By submitting a Recipe and/or Video and accepting a trip, each Finalist agrees that the Recipe and Video (if any) they submit will become the sole and exclusive property of the Sponsor, and each Entrant assigns all right, title, and interest, including all copyright and intellectual property rights, in the Recipe and Video (if any) to Sponsor. To the extent that the law does not support such an assignment, the Entrant hereby grants Sponsor and Authorized a perpetual, worldwide, royalty-free, exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Recipe and Video (if any), in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to Entrant or any third party.
13. HOLD HARMLESS, RELEASE AND INDEMNIFICATION: By participating in the Contest, either as an Entrant or otherwise including by voting (each a “participant”), participants agree to release, indemnify, defend and hold harmless the Contest Entities, Authorized Users, and each of their employees, officers, directors, shareholders, agents, representatives, and contractors, as well as Facebook and Instagram (“Released Parties”) from and against any and all claims, expenses, and liability arising out of my participation in this Contest including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's Entry, creation of an Entry or submission of an Entry, voting in the Contest, other participation in the Contest, acceptance or use or misuse of prize (including any travel or Activities related thereto), and/or the broadcast, exploitation or use of Footage.
14. MISCELLANEOUS PROVISIONS: If Sponsor so elects, Finalists may be required to submit to a confidential background check to help ensure that a Finalist will not pose a safety threat or, in the Sponsor’s sole discretion, bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. Sponsor reserves the right to disqualify the Finalist based on the results of his/her background check. If requested, the Finalist agrees to sign waiver forms authorizing the release of personal and background information. Sponsor reserves the right, in its sole discretion, to void any and all participants who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Contest. Sponsor reserves the right to cancel, terminate or modify the Contest (each a “Contest Change”) if the Contest cannot be completed as planned for any reason, including but not limited to an unforeseen event (“Unforeseen Event”) such as infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort, or force majeure event (including without limitation epidemic, pandemic, communicable, contagious, or infectious disease or public health quarantine that impacts the anticipated participation in the Contest). In such event, Sponsor may (a) cancel the Contest entirely, (b) award the Grand Prize Trip from eligible Entries received prior to the Unforeseen Event resulting in the Contest Change using reasonable alternative methodology if sufficient eligible Entries have been received (as determined in Sponsor’s sole discretion), or (c) extend the Contest Entry Period to allow time for more eligible Entries to be received. It is understood that an Unforeseen Event must take place for the Sweepstake Change to be effectuated by Sponsor and that such Contest Change is not simply at Sponsor’s option for any reason. Sponsor reserves the right in its sole discretion to disqualify any participant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner and void all associated Entries, votes, and/or prizes claims. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Rules will be awarded. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.

LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) for late, lost, jumbled, garbled, misdirected, delayed, incomplete, incorrect, or inaccurate entries, game plays, prize claims, email, mail, or other communications of any kind, whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (3) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) technical, network, mechanical, typographical, human or other error or problem which may occur in connection with the Contest, including, but not limited to, errors or problems which may occur in the administration of the Contest or the processing of Entries, votes, the announcement of the prizes, or in any Contest-related materials; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize (including any travel or activity-related thereto). If for any reason an Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant's sole remedy is to submit another Entry in the Contest, provided that the Contest has not ended.
16. DISPUTES/GOVERNING LAW: Each participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, other than those concerning the administration of the Contest or the determination of Winners or for any disputes arising from the loss or injury from the participation in a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Rules (except for any disputes arising from the loss or injury from the use of prizes) shall be submitted to final, binding arbitration conducted in the State of Florida under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Florida state or federal court judge with experience in entertainment matters who shall follow Florida law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in the state of Florida, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties, shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of the state of Florida. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in the state of Florida; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iv) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
17. PRIVACY NOTICE AND DATA COLLECTION: Contest participation is voluntary. Information including personal information which may be collected from participants through this Contest are available through Sponsor’s privacy policy at https://www.travelandleisureco.com/VOR-privacy-notice. By participating in the Contest, participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
NOTICE OF FINANCIAL INCENTIVE FOR CALIFORNIA RESIDENTS: If you are a California resident, the prize(s) offered under this Contest may be considered a “financial incentive” under the California Consumer Privacy Act, as amended (the “CCPA”). Generally, we do not assign monetary or other value to personal information. However, in the event we are required by law to assign such value in the context of this program, or price or service differences, we have valued the personal information collected and used as being equal to the value of the discount or financial incentive provided and the calculation of the value, in this case, is based upon a practical and good-faith effort involving the expenses associated with offering the incentives. The personal information categories collected may include (i) identifiers such as name, email address, zip code, mobile number, age range; (ii) customer records; (iii) internet activity; and/or (iv) profiles and inferences from any of this information. The personal information provided will be collected, used, and disclosed to administer this Contest and otherwise as set forth in our Privacy Notice. BY SUBMITTING AN ENTRY FOR CONSIDERATION IN THIS CONTEST, ENTRANT HEREBY GRANTS SPONSOR RIGHTS TO USE THE ENTRANT’S NAME, LIKENESS, AND ENTRY MATERIALS, AMONG OTHER THINGS, NOW AND IN THE FUTURE. SEE RULE 11 FOR COMPLETE DETAILS.
1. OVERVIEW: The Margarita Madness contest (the “Contest”) is sponsored by Margaritaville Vacation Club, Inc., 501 W. Church St., Orlando, FL 32805 (“Sponsor”). The Contest takes place in two parts. An initial submission of a Recipe (as defined in Rule 4) (and optional Video, as defined in Rule 4) by Entrants to be judged by Sponsor representatives to identify four Finalists (as defined in Rule 6) who will receive a trip to Margaritaville Vacation Club Orlando where they will participate in Activities (defined in Rule 7), including making their Recipe, which Sponsor may Film (as defined in Rule 7) to share on Voting Sites (as defined in Rule 8) for public voting to determine the one (1) grand prize winner (“Winner”). In order to participate in the Contest and be considered for a prize, each Entrant agrees to comply with all requirements set forth in these Official Rules (“Rules”) and with Sponsor’s decisions and directions. In order to be verified as a Finalist or Winner, and to receive the prize associated with such designation, each potential finalist will be required to sign paperwork provided by Sponsor granting Sponsor the right to use their name, likeness, voice, image, biographical information, Recipe and any Finalist Footage (as defined in Rule 7) or Grand Prize Footage (as defined in Rule 9) Filmed by Sponsor (collectively “Footage”).
2. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States, District of Columbia and Puerto Rico, who are 21 years of age or older (each an “Entrant”). Employees of Margaritaville Vacation Club, Inc. and its affiliated companies, advertising/promotion agencies, and any other company or individual involved with the design, execution or administration of the Contest (collectively with Sponsor, the "Contest Entities") and any immediate family member (defined as a spouse, parent, or child; whether biological, adopted, step or in-law) or household member (whether related or not) of any such employee are not eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes entrant's full and unconditional agreement to these Official Rules and to Sponsor's decisions, which are final and binding in all matters related to the Contest.
3. TIMING: The Contest begins at 12:00:01 a.m. Eastern Time (“ET”) on April 2, 2026 and ends when the Winner has been verified and completed their Grand Prize Trip (as defined in Rule 9), or when Sponsor announces the Contest has ended, whichever occurs first (“Contest Period”). Within the Contest Period, there is an Entry Period, Finalist Judging Period, Finalist Trip Period, and Public Voting Period, as defined below. The clock on Sponsor's server shall be the official timekeeping device for this Contest.
a. Entry Period. Entry into the Contest begins at 12:00:01 a.m. ET on April 2, 2026 and ends at 11:59:59 p.m. ET on April 24, 2026 (the "Entry Period").
b. Finalist Judging Period. Sponsor may start judging Entries (as defined in Rule 4) as they come in and will complete judging Entries and notify potential finalists by April 30, 2026 (the “Finalist Judging Period”).
c. Finalist Trip Period. The four Finalists will participate in a trip where they will be Filmed (as defined in Rule 7) creating their Recipe (as defined in Rule 4.b) and participating in other Activities (as defined in Rule 7) between May 16, 2026 to May 24, 2026 (the “Finalist Trip Period”).
d. Public Voting Period. Starting at 12:00 a.m. ET on Jun 1, 2026 and ending at 11:59:59 p.m. ET on June 4, 2026 Sponsor will post each Footage of each Finalist and their Recipe on the Voting Sites (as defined in Rule 8) (the “Public Voting Period”).
4. HOW TO ENTER: To enter the Contest, Entrants must visit https://mgvcgiveaways.com/marg-madness/rules (the “Contest Website”) and follow the on-screen directions to submit the following:
a. Official Entry Form. Entrants must complete the official online entry form found on the Contest Website with all required information including first and last name, home street address, date of birth, email address (which must remain the same throughout the Entire Contest Period as this will be the primary method of communication between Sponsor and Entrant), and Entrant’s confirmation that (s)he has read and agrees to the Rules (“Entry Form”).
b. Original Margarita Recipe. Entrants must upload an original margarita recipe (the “Recipe”) as specified on the Contest Website. The Recipe must meet the Additional Requirements detailed in Rules 5, below.
c. (Optional) Entrant Video. Entrants have the option of uploading a video of no more than two minutes in duration in which the Entrant appears and describes their margarita recipe (the “Video”). The Video is optional and will only be viewed by the judges in the event there is a tie in the scores to determine the top for Recipes submitted per the judging criteria set forth in Rule 6, below. If a Video is submitted, only one (1) person may appear in the Video, and that one person must be the Entrant identified on the Entry Form. The Video must meet the Additional Requirements detailed in Rules 5, below or it will not be considered as part of the Entry.
The Entry Form, Recipe and Video (if there is a Video) are together the Entrant’s “Entry.” Limit one (1) Entry per person and per email address. If more than one Entry is received from the same person or email address, all but the first Entry will be disqualified. Any Entries received that are not in conformance with these Rules will be disqualified. Entries become the property of Sponsor and may not be acknowledged and will not be returned.
5. ADDITIONAL REQUIREMENTS: Entries must meet the following additional requirements (“Additional Requirements”), all as determined by Sponsor in its sole and absolute discretion:
a. All written and spoken word in the Entry must be in English.
b. The entire Entry must be the original work of, and wholly created by, the Entrant.
c. Entrants must have all legal rights necessary to submit the Entry and to grant Sponsor the rights to use the Entry, in whole or in part, as authorized and contemplated in these Rules.
d. Entrants may not use artificial intelligence technology to create or submit an Entry.
e. The Entry cannot be derogatory of any ethnic, racial, gender, religious, professional, political or age group.
f. The Entry cannot be sexually explicit or suggestive, be unnecessarily violent, or contain profanity, nudity or pornographic material.
g. The Entry cannot depict or suggest any materially dangerous activity or any inappropriate content.
h. The Entry cannot depict, reference or promote illegal consumption of alcohol, excessive consumption of alcohol, illegal drug use or activity, tobacco use, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message.
i. The Entry cannot be obscene or offensive, defamatory, libelous, threatening, harassing, or endorse any form of hate or hate group.
j. The Entry cannot defame, misrepresent or contain disparaging remarks about Sponsor, or other people, products, or companies.
k. The Entry cannot infringe on the rights of any third party (including, without limitation, any intellectual property rights, publicity rights or privacy rights; to this end, avoid using any brand names in your Recipe or showing any labels or copyrighted images in your Video).
l. The Entry cannot advertise or promote any brand or product of any kind other than the Sponsor’s, including, but not limited to, any of Sponsor’s competitors.
m. The Entry must not be, or contain anything that is, unlawful or in violation of or contrary to the laws or regulations of the United States or any state or jurisdiction therein.
In the event Sponsor determines that an Entry, or part of an Entry, violates any of these Additional Requirements, Sponsor reserves the right to void the entire Entry. Alternatively, in Sponsor’s sole and absolute discretion, Sponsor may modify the Entry (or portion thereof) to remove the portion that violates the Additional Requirements (e.g., remove a brand name and replace it with a generic name). Sponsor’s decision on how to treat an Entry that violates any Additional Requirements is not subject to objection or appeal.
6. FINALIST JUDGING: During the Finalist Judging Period, a panel of Sponsor’s representatives will judge all eligible Entries based on the following judging criteria with each criteria given equal weight:
a. Creativity of the Recipe;
b. Feasibility of the Recipe; and
c. Brand Fit of the Recipe.
The four Entrants with the overall highest scores on their Recipes after initial judging will be deemed the potential finalists, subject to verification. In the event of a tie for a potential finalist spot, the tie will be broken based on the Entrant who receives the highest score in the Brand Fit criteria. If a tied Entrant included a Video as part of their Entry, Sponsor will include that Entrant’s Video as part of the judging to break the tie (“First Tie Breaker”). If neither or none of the tied Entrants included a Video, or if a tie remains after the First Tie Breaker, Sponsor will select as the winner of the tie the tied Entrant who submitted their Entry first (“Second Tie Breaker”). The potential finalists will be notified by email at the email addresses each provided in their Entry Form (“Finalist Notification”). An Affidavit of Eligibility, Liability/Publicity Release (where legal), and Assignment of Rights in Entry and Footage (collectively “Finalist Documents”) will be attached to the Finalist Notification. Each potential finalist must complete, sign, have notarized where requested, and return the Finalist Documents in their entirety within five (5) days of the send date of the Finalist Notification. In the event a Finalist Notification is returned as undeliverable or if a potential finalist fails to return the completed Finalist Documents within the timeframe specified or if a potential finalist fails to comply with the Rules or is otherwise determined to be ineligible for any reason, that potential finalist will be disqualified and will forfeit any claim to the Finalist Trip or Grand Prize Trip. Once the Sponsor has received a potential finalist’s completed Finalist Documents and confirms that potential finalist is eligible and in compliance with all Rules and verification requirements, such potential finalist will be deemed a “Finalist.” In the event a potential finalist is disqualified, Sponsor, in its sole discretion, may notify the Entrant who had the next highest scoring Recipe (or Recipe/Video in the event of a First Tie Breaker) to be a potential finalist and complete the verification process detailed above, or Sponsor may choose to proceed with fewer Finalists. A maximum of four (4) Finalists will be verified to receive a Finalist Prize. If there are an insufficient number of qualified Entrants, Sponsor may reduce the number of Finalists.
7. FINALIST TRIP: The four (4) Finalists will each receive a 3 day/2 night trip for the Finalist and one guest to the Margaritaville Vacation Club Orlando in Orlando, Florida (the “Resort”) where they will participate in interviews and activities (collectively “Activities”) as determined and directed by Sponsor (the “Finalist Trip”). The Finalist Trip must be completed during the Finalist Trip Period. The Finalist Trip includes a $1000 flight credit for the Finalist to use to arrange travel to/from their home and Orlando, a balcony stateroom at the Resort during the Finalist Trip, and a $600 food credit to use at the Resort during the Finalist Trip. All other costs and expenses not expressly stated herein as being included in the Finalist Trip are the sole responsibility of the Finalist; this includes without limitation ground transportation, tips, damage fees, incidental fees, or food/beverage charges that are outside the scope or exceed the value of the food credit. Each Finalist will be required to provide a valid driver’s license or state identification card, and a valid credit card, prior to booking and check-in at the Resort. Finalists will be required to participate in all Activities requested by Sponsor between the hours of 8:00 a.m. ET and 8:00 p.m. ET on one day during the Finalist Trip (exact day and times to be determined by Sponsor) (the “Production Day”), not to exceed a combined total of eight (8) hours on the Production Day. One Activity that each Finalist should be prepared for on the Production Day is to make their Recipe while being filmed/recorded (the “Recipe Video”). Sponsor will provide the ingredients listed in the Recipe for the Recipe Video (exact brands of ingredients will be determined by Sponsor in its sole discretion). Sponsor may film, video or otherwise record (audio and/or visual) (collectively “Film”) all Activities on the Production Day, as well as any other activities that the Finalists participates in while in public areas of the Resort during the Finalist Trip (collectively “Finalist Footage”). The approximate retail value (“ARV”) of each Finalist Trip is $2400. Actual value may vary based on Finalist’s departure city and airfare rates at time of booking/travel. If actual value of trip is less than the ARV, the difference will not be awarded. Finalist Trip prizes are subject to additional details as noted in Rule 10.
8. PUBLIC VOTING: Sponsor will create a profile of each Finalist that includes all or part of the Recipe Video and other portions of the Finalist Footage (which may be edited by Sponsor in Sponsor’s sole discretion) collected during the Finalist Trip to create a “Finalist Profile.” Sponsor will share each Finalist Profile on Sponsor’s Instagram Stories [https://www.instagram.com/margaritavillevc/] and Facebook page [https://www.facebook.com/MargaritavilleVacationClub](together the “Voting Sites”) during the Public Voting Period, using each platform’s polling feature to collect votes for the Recipe you think is most creative and would most like to see on the menu (“Public Voting Criteria”). In order to vote, members of the public must have a valid account on the social media platform on which they seek to vote, but they do not have to be a follower of Sponsor’s page or account. Limit one vote per person/social media account per Voting Site. The Finalist that receives the most valid votes across both Voting Sites combined during the Public Voting Period will be deemed the Grand Prize Winner, subject to verification.
9. GRAND PRIZE TRIP: The one (1) Grand Prize Winner will receive a four (4) night cruise trip aboard the Margaritaville at Sea for winner and one guest (“Grand Prize” or “Cruise”). Trip includes a $1000 flight credit for the Finalist to use to arrange travel to/from their home and the airport nearest the embarkation and debarkation point for the Cruise. Cruise includes one (1) balcony stateroom for the Grand Prize Winner and one (1) guest, two (2) standard beverage packages that include alcoholic beverages, and standard onboard dining options included as part of the Cruise fare. The Grand Prize excludes any shore excursions, specialty dining venues or upgraded dining experiences that require an additional fee, spa services, premium activities, onboard purchases, and any other optional services or experiences not expressly included in the standard Cruise package.
10. . Sponsor may Film Grand Prize Winner and Guest while they are participating in any activities in public areas during the Cruise (“Grand Prize Footage”). All other costs and expenses not expressly stated herein as being included in the Grand Prize are the sole responsibility of the Grand Prize Winner; this includes without limitation travel expenses, food/beverage not included as part of the standard Cruise package, tips, damage fees, and incidental fees. ARV of Grand Prize: $2400 Travel dates are subject to availability and blackout dates may apply. Grand Prize must be completed by 6/1/2027 or it will be forfeited in its entirety and nothing awarded.
11. ADDITIONAL TRIP DETAILS AND PRIZE REQUIREMENTS: The Finalists and Winner (each a “Trip Winner”) must be able to travel on designated dates or by designated expiration date (as the case may be) or prize will be forfeited and an alternate Finalist or Winner may be selected, in Sponsor’s sole discretion. Trip Winner will be required to provide a valid credit card (to cover any expenses/fees incurred tat are not part of trip package), government issued identification, and any other required travel documentation (e.g., passport if necessary) prior to booking or upon check in (as directed by Sponsor). Finalists and Winner, and their Guests, are solely responsible for obtaining travel and medical insurance, and all other forms of insurance, that they deem necessary or advisable as Sponsor has not and will not obtain such insurance on their behalf. If a Trip Winner is allowed to bring a Guest, such Guest must be 21 years of age or older and Trip Winner must notify Sponsor in advance of booking of the name of such Guest. Guest must sign a Liability/Publicity Release and Assignment of Rights in Footage prior to booking and within time frame specified by Sponsor. Once made, all travel dates are final. If travel credits are provided, Trip Winner is responsible for booking travel within those amounts him/herself. Neither Sponsor nor any other of the Released Parties shall be responsible for any cancellations, delays, diversions or substitutions, or any acts or omissions whatsoever, by any carriers, hotel operators, venue operators, transportation companies or other persons in connection with the a trip. Without limiting the foregoing, neither Sponsor nor any other Released Parties will be in any way responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of a trip is delayed, postponed, re-scheduled or cancelled for any reason whatsoever (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate disease transmission, or due to any other cause of any kind or nature whatsoever). Travel is subject to the terms and conditions set forth in this Contest. Prizes will be awarded only if the potential winner fully complies with these Rules. Prizes are non-transferable and cannot be substituted or exchanged for cash, except by Sponsor in the event that an advertised prize becomes unavailable in which case Sponsor may award a prize of equal or greater value. The Trip Winner and Guest must travel together on the same itinerary. If Trip Winner does not take a Guest on a trip, no credit or refunds will be awarded.
Any tickets, vouchers, gift cards, gift certificates or like items (collectively “Vouchers”) issued in connection with this Contest are subject to the terms stated thereon or as set by the issuer. Sponsor will not replace any lost, mutilated, or stolen Vouchers. Prizes are not transferable and may not be redeemed for cash value. All federal, state and local taxes on prizes are the sole responsibility of the winner. No substitutions of prize, except Sponsor may substitute a prize, or portion thereof, for one of equal or greater value at Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All prize details are at Sponsor’s sole discretion. Unclaimed prizes may not be awarded. The total ARV of all prizes for the Contest is $2400.
12. GRANT OF RIGHTS:
a. Participants Who Are Not Selected as Finalists.
i. Identity. By submitting an Entry or casting a vote, participants grant Sponsor, and anyone authorized by Sponsor (“Authorized Users”), the right to use their name, likeness, voice, statements, identity, and biographical information (“Identity”) for advertising and publicity purposes in any and all media now known or hereafter devised during the Contest Period and a reasonable run off period thereafter for purposes of promoting Sponsor and the Contest.
ii. Video. By submitting a Video, Entrants grant Sponsor and Authorized users the worldwide, royalty-free, non-exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Video, in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, during the Contest Period and a reasonable run off period thereafter for purposes of promoting Sponsor and the Contest.
iii. Recipe. By submitting a Recipe, Entrants grant Sponsor and Authorized Users a perpetual, worldwide, royalty-free, non-exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Recipe, in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to entrant or any third party.
b. Finalists and Winner.
i. Identity. By submitting an Entry and accepting a trip, Finalists grant Sponsor and Authorized Users the right to use their name, likeness, voice, statements, identity, and biographical information (“Identity”) for advertising and publicity purposes in any and all media now known or hereafter devised for advertising, marketing and publicity purposes without territorial or time limitations.
ii. Recipes and Videos. By submitting a Recipe and/or Video and accepting a trip, each Finalist agrees that the Recipe and Video (if any) they submit will become the sole and exclusive property of the Sponsor, and each Entrant assigns all right, title, and interest, including all copyright and intellectual property rights, in the Recipe and Video (if any) to Sponsor. To the extent that the law does not support such an assignment, the Entrant hereby grants Sponsor and Authorized a perpetual, worldwide, royalty-free, exclusive, sublicensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse their Recipe and Video (if any), in whole or in part, edited or unedited, in any and all media now known or hereafter devised, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to Entrant or any third party.
13. HOLD HARMLESS, RELEASE AND INDEMNIFICATION: By participating in the Contest, either as an Entrant or otherwise including by voting (each a “participant”), participants agree to release, indemnify, defend and hold harmless the Contest Entities, Authorized Users, and each of their employees, officers, directors, shareholders, agents, representatives, and contractors, as well as Facebook and Instagram (“Released Parties”) from and against any and all claims, expenses, and liability arising out of my participation in this Contest including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's Entry, creation of an Entry or submission of an Entry, voting in the Contest, other participation in the Contest, acceptance or use or misuse of prize (including any travel or Activities related thereto), and/or the broadcast, exploitation or use of Footage.
14. MISCELLANEOUS PROVISIONS: If Sponsor so elects, Finalists may be required to submit to a confidential background check to help ensure that a Finalist will not pose a safety threat or, in the Sponsor’s sole discretion, bring the Sponsor into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Sponsor. Sponsor reserves the right to disqualify the Finalist based on the results of his/her background check. If requested, the Finalist agrees to sign waiver forms authorizing the release of personal and background information. Sponsor reserves the right, in its sole discretion, to void any and all participants who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, or proper play of this Contest. Sponsor reserves the right to cancel, terminate or modify the Contest (each a “Contest Change”) if the Contest cannot be completed as planned for any reason, including but not limited to an unforeseen event (“Unforeseen Event”) such as infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or corruption of any sort, or force majeure event (including without limitation epidemic, pandemic, communicable, contagious, or infectious disease or public health quarantine that impacts the anticipated participation in the Contest). In such event, Sponsor may (a) cancel the Contest entirely, (b) award the Grand Prize Trip from eligible Entries received prior to the Unforeseen Event resulting in the Contest Change using reasonable alternative methodology if sufficient eligible Entries have been received (as determined in Sponsor’s sole discretion), or (c) extend the Contest Entry Period to allow time for more eligible Entries to be received. It is understood that an Unforeseen Event must take place for the Sweepstake Change to be effectuated by Sponsor and that such Contest Change is not simply at Sponsor’s option for any reason. Sponsor reserves the right in its sole discretion to disqualify any participant it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other Contest or in an unsportsmanlike or disruptive manner and void all associated Entries, votes, and/or prizes claims. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Rules will be awarded. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision.
15. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) for late, lost, jumbled, garbled, misdirected, delayed, incomplete, incorrect, or inaccurate entries, game plays, prize claims, email, mail, or other communications of any kind, whether caused by any of the equipment or programming associated with or utilized in this Contest or by any human error; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (3) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) technical, network, mechanical, typographical, human or other error or problem which may occur in connection with the Contest, including, but not limited to, errors or problems which may occur in the administration of the Contest or the processing of Entries, votes, the announcement of the prizes, or in any Contest-related materials; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize (including any travel or activity-related thereto). If for any reason an Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant's sole remedy is to submit another Entry in the Contest, provided that the Contest has not ended.
16. DISPUTES/GOVERNING LAW: Each participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, other than those concerning the administration of the Contest or the determination of Winners or for any disputes arising from the loss or injury from the participation in a Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Rules (except for any disputes arising from the loss or injury from the use of prizes) shall be submitted to final, binding arbitration conducted in the State of Florida under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Florida state or federal court judge with experience in entertainment matters who shall follow Florida law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in the state of Florida, including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Released Parties, shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of the state of Florida. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in the state of Florida; (iii) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (iv) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
17. PRIVACY NOTICE AND DATA COLLECTION: Contest participation is voluntary. Information including personal information which may be collected from participants through this Contest are available through Sponsor’s privacy policy at https://www.travelandleisureco.com/VOR-privacy-notice. By participating in the Contest, participants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
NOTICE OF FINANCIAL INCENTIVE FOR CALIFORNIA RESIDENTS: If you are a California resident, the prize(s) offered under this Contest may be considered a “financial incentive” under the California Consumer Privacy Act, as amended (the “CCPA”). Generally, we do not assign monetary or other value to personal information. However, in the event we are required by law to assign such value in the context of this program, or price or service differences, we have valued the personal information collected and used as being equal to the value of the discount or financial incentive provided and the calculation of the value, in this case, is based upon a practical and good-faith effort involving the expenses associated with offering the incentives. The personal information categories collected may include (i) identifiers such as name, email address, zip code, mobile number, age range; (ii) customer records; (iii) internet activity; and/or (iv) profiles and inferences from any of this information.
